Welcome to ReelKeepsake. These Terms of Service ("Terms") govern your use of reelkeepsake.com (the "Site") and your purchase of our products. By using the Site or placing an order, you agree to these Terms.
1. Who We Are
The Site is operated by [AimStar, LLC], a Delaware limited liability company ("ReelKeepsake," "we," "us"). Contact: hello@reelkeepsake.com.
2. Eligibility
You must be at least 18 years old to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate.
3. Your Content — Photos and Personalization
When you upload photos or text to create a custom product ("Your Content"), the following applies:
Your ownership. You retain all rights to Your Content. We claim no ownership of your photos.
License to us. You grant us a limited, non-exclusive license to use, reproduce, and modify Your Content solely as necessary to produce, quality-check, and fulfill your order (including sharing it with our production partners for that purpose). This license ends when your order is complete, subject to the retention period described in our Privacy Policy.
Your responsibilities. By uploading content, you represent and warrant that:
- You own the content or have permission from the owner to use it;
- Your content does not infringe any copyright, trademark, privacy, or publicity rights of any person;
- Any person appearing in your photos has consented (or, for minors, their parent/guardian has consented) to the photo being used in a custom product;
- Your content is not illegal, obscene, hateful, or harmful — we do not produce content depicting nudity, violence, hate symbols, or the sexualization of minors.
Our right to refuse. We may decline to produce any order containing content that violates these Terms or that we reasonably believe is unlawful or inappropriate. If we decline your order, we will refund you in full.
Indemnity. You agree to indemnify us against claims arising from Your Content, including claims that it infringes third-party rights.
4. Orders and Payment
- All prices are in U.S. dollars. Applicable sales tax is calculated at checkout.
- Payment is processed at the time of purchase through Shopify Payments.
- We may cancel any order at our discretion (for example, suspected fraud or content violations); if we cancel, you receive a full refund.
- Submitting an order constitutes an offer to purchase; our order confirmation email constitutes acceptance.
5. Custom Products
Our products are made to order from Your Content. Please review your photos and personalization carefully before submitting. Order changes and cancellations are governed by our Refund Policy. Colors and brightness of physical film may differ from what you see on a backlit screen; such differences are inherent to the medium and are not defects.
6. Shipping and Risk of Loss
Shipping terms are described in our Shipping Policy. Risk of loss passes to you upon delivery to the address you provided. Lost-in-transit packages are handled as described in our Refund Policy.
7. Returns and Refunds
Governed by our Refund Policy, which is incorporated into these Terms.
8. Intellectual Property (Our Content)
The Site and its contents — including our name, logo, product designs, text, graphics, and photos — are owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce, or use them for commercial purposes without our written permission.
9. Prohibited Uses
You agree not to use the Site to violate any law, infringe others' rights, transmit malware, scrape or harvest data, interfere with the Site's operation, or place fraudulent orders.
10. Disclaimers
The Site and products are provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, except as expressly stated in our Refund Policy.
11. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from these Terms or your order will not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Some states do not allow certain limitations, so some of the above may not apply to you.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute will first be attempted to be resolved informally by contacting hello@reelkeepsake.com.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the Site after changes constitutes acceptance.
